Nieves is claiming a building that was demolished in 2019

RESOLUTION

Having examined the application submitted by Ms Nieves Balaguer, chartered property manager no. 3112, requesting a permit to repair the roof of the building at 14 Malvarrosa Street.

WHEREAS the said building is recorded as demolished in this same file, under a demolition certificate signed on 11 October 2019 by the municipal building surveyor Mr Ángel Sarrión.

WHEREAS the applicant states that the building is still standing and inhabited by forty-one residents, and submits twelve photographs dated last week.

CONSIDERING that a photograph does not establish the existence of a property and that the only admissible document for that purpose is the land registry certificate.

CONSIDERING that the said certificate was cancelled ex officio on 11 October 2019 on grounds of demolition of the building.

I HEREBY RESOLVE: to reject the application. Works cannot be authorised on a building that does not exist.

NOTE OF SERVICE: service having been attempted at 14 Malvarrosa Street, it is placed on record that the envelope was handed over in person and that Ms Nieves Balaguer signed the acknowledgement of receipt. With the annex now closed, the forty-one residents are entered in the municipal register as being of no known address.
