Amalia arrives 11 days late for niche 214

FILE COVER SHEET. San Bartolomé de la Vega, a municipality of 18,400 inhabitants, 7 October 2024.

Amalia Roldán Sanz, 58, a bus driver, filed her objection concerning niche 214 eleven days after the deadline. The licence for Abel Roldán Mena, an electrician who died on 14 July 1974, had reached fifty years.

File number: CEM-2024-038. Handling unit: Municipal Cemetery. Officer responsible: Purificación Adame, the public employee in charge of licences. Head of service: Bernabé Coz, responsible for funeral services.

PUBLIC NOTICE OF EXPIRY OF LICENCES. 1 August 2024.

The Town Council of San Bartolomé de la Vega informs interested parties that the licences listed in the annex have reached the maximum term of fifty years laid down in the municipal by-law. The annex includes niche 214, north courtyard, third row, granted on 17 July 1974 for the burial of Abel Roldán Mena, an electrician aged 36.

Until 20 September 2024 it is possible to file objections, request a renewal where one is available, or name an alternative destination for the remains. If the deadline passes with no reply, the Council will authorise the exhumation, will place the remains in the common ossuary and may grant a new licence over the space released.

Publication in the Provincial Official Gazette shall replace personal notification where the latter cannot be served at the registered address.

Signed: Purificación Adame. Employee number: 0417.

RECORD OF PERSONAL NOTIFICATION. 5 August 2024.

Purificación Adame, clerk of the municipal cemetery, records that the last address given by the licence holder appears on the 1974 card: 18 Calle del Olmo, second floor right. The registered holder is Adela Sanz Pujol, widow of the deceased Abel Roldán Mena.

A registered letter with proof of delivery is sent, code CEM038214. The letter contains a copy of the public notice, the final date for objections and an express warning of transfer to the common ossuary.

Signed: Purificación Adame. Employee number: 0417.

RETURN BY THE POSTAL SERVICE. 12 August 2024.

Item CEM038214. Outcome: address does not exist. Delivery note: building demolished; street numbering removed. Second attempt impossible.

Council date stamp: 12 August 2024, 10:06.

HANDWRITTEN NOTE IN THE MARGIN OF THE RETURN. 12 August 2024.

"The address no longer exists. Can we trace the daughter before we publish? Thirty-nine days left. P. Adame."

INTERNAL EMAIL. 13 August 2024, 08:17.

From: Purificación Adame, licences clerk.

To: Bernabé Coz, head of funeral services.

Subject: CEM-2024-038, possible further search.

The letter for niche 214 has come back because 18 Calle del Olmo was demolished. In the 2002 file there is an unsigned note mentioning a daughter, Amalia, but it gives no telephone number or address. I request authorisation to consult the register of inhabitants before sending the notice to the gazette. We could still notify within the deadline if we obtain a current address.

Purificación Adame.

REPLY TO INTERNAL EMAIL. 13 August 2024, 09:02.

From: Bernabé Coz, head of funeral services.

To: Purificación Adame, licences clerk.

Subject: Re: CEM-2024-038, possible further search.

The by-law requires notification at the address supplied by the licence holder and publication in the alternative where the attempt fails. It does not authorise a general search of the register of inhabitants for expiry files. Proceed by gazette.

The annual programme covers thirty-eight licences. We need them closed before 15 October: the new columbarium has twenty-four spaces committed and the waiting list holds thirty-one families. Leave an alert on the card in case anyone calls before the term runs out.

Bernabé Coz.

The Municipal Secretariat certifies that notice CEM-2024-038 was published in the Provincial Official Gazette number 159, of 20 August 2024, page 47, and that the text was posted on the Council's electronic noticeboard from 08:00 that same day. It will remain visible until 23:59 on 20 September. RECORD OF EXPIRY OF THE DEADLINE. 21 September 2024, 08:11.

Purificación Adame, the officer responsible, consults the general register and records that no objection concerning niche 214 has been filed. Nor is there any request for renewal, change of address, appointment of a new responsible party or choice of another destination for the remains.

The Secretariat's certification that the notice remained on the electronic noticeboard until 23:59 yesterday is added to the file. It is proposed to proceed with the exhumation and reassignment set out in the notice.

HANDWRITTEN NOTE IN THE MARGIN. 21 September 2024.

"Checked twice up to 08:30. No entry. P. Adame."

WORK ORDER. 23 September 2024.

Bernabé Coz, head of funeral services, includes niche 214 in the batch of exhumations for 4 October. Work will begin at 07:30. The remains will be identified during the transfer by the reference R-214-1974 and will be placed in compartment OC-C-18 of the common ossuary.

The office may suspend the operation only by court order, proven material error or an objection registered within the deadline. Once the remains have been placed in the collective compartment, individual recovery cannot be guaranteed.

APPLICATION FILED AT THE REGISTRY. 1 October 2024, 13:48.

I, Amalia Roldán Sanz, aged 58, driver on interurban route 27 and resident of San Bartolomé de la Vega, state that Abel Roldán Mena, an electrician who died on 14 July 1974, was my father. I went to the cemetery this morning to clean the stone before All Saints' Day and found a red mark with the reference CEM-2024-038.

My mother, Adela Sanz Pujol, the holder of the licence, died on 6 May 2019. 18 Calle del Olmo ceased to exist when the block was pulled down in 2003. We have lived at 41 Avenida de las Eras since that year. I did not know that I had to report the address to the cemetery and I have not received the letter.

I request the immediate suspension of the exhumation and the renewal of the licence in my name. I accept payment of the outstanding fees and any processing costs. I enclose my mother's death certificate, the family record book and a copy of my identity document, and I give as means of notice the telephone number and email address recorded on the registry form.

Signed: Amalia Roldán Sanz.

RECEIPT FROM THE GENERAL REGISTRY. 1 October 2024, 13:48.

Entry number 2024-11973. Related file: CEM-2024-038. Published deadline: 20 September 2024. Delay: eleven calendar days.

This receipt evidences the filing and does not by itself suspend the scheduled operation.

Stamp of the General Registry.

URGENT INTERNAL EMAIL. 1 October 2024, 13:56.

From: Purificación Adame, licences clerk.

To: Bernabé Coz, head of funeral services.

Subject: CEM-2024-038, interested party located.

Amalia Roldán Sanz, the daughter of the deceased, has come forward. The address used disappeared in 2003 and the holder died in 2019. She proves the relationship and offers to pay for the renewal. The exhumation is scheduled for three days from now.

I request that niche 214 be temporarily withdrawn from the batch until the application is resolved. The notification by gazette is correct, but we now have an identified person who wants to keep the grave.

Purificación Adame.

REPLY TO THE URGENT INTERNAL EMAIL. 1 October 2024, 14:21.

From: Bernabé Coz, head of funeral services.

To: Purificación Adame, licences clerk.

Subject: Re: CEM-2024-038, interested party located.

Draw up a report on the deadline and prepare the decision. Do not withdraw the niche from the batch without grounds provided for in the by-law. The publication was valid and the interested party came forward eleven days late.

The annual quota has to be closed. Space 214 is reserved for a new licence applied for on 9 January by a family that has been waiting since then. I need the file resolved before Thursday at 12:00.

Bernabé Coz.

REPORT BY THE HEAD OF SERVICE. 2 October 2024.

Bernabé Coz, head of funeral services, reports that the licence reached its maximum term, that the letter was sent to the address supplied by the holder, that the postal return was documented and that the notice remained published throughout the whole period. The interested party did not report the holder's death or the change of address.

The application proves the family relationship, but it was registered on 1 October, eleven days after expiry. The by-law does not allow the renewal of a licence that has lapsed once the exhumation has been ordered. Neither does it grant suspensive effect to an application filed after the deadline.

It is proposed to reject the renewal, to maintain the operation of 4 October and to inform Amalia Roldán Sanz of the reference assigned to the remains until they enter the common ossuary.

Signed: Bernabé Coz. Professional code: JSF-09.

DECISION. 3 October 2024, 10:12.

The application by Amalia Roldán Sanz is rejected as out of time. The exhumation of niche 214 is maintained for 4 October at 07:30. The interested party may collect the stone and the ornamental items within thirty days, by appointment with the office.

This decision shall be notified at the address given in the application and, as an additional warning, at the email address provided by the interested party. Any subsequent complaint may examine the lawfulness of the procedure, but will not suspend the operation without an express ruling.

PROOF OF ELECTRONIC NOTICE. 3 October 2024, 10:14.

Message delivered to the destination server. Subject: Decision on file CEM-2024-038. Attached document: signed decision. Read receipt confirmed: 3 October 2024, 10:19.

RECORD OF EXHUMATION AND TRANSFER. 4 October 2024.

At 07:32 niche 214 in the north courtyard is opened. The plate identifies Abel Roldán Mena, an electrician, born on 2 February 1938 and deceased on 14 July 1974. The match with the burial book and with reference CEM-2024-038 is verified.

At 07:51 the remains are placed in funeral box R-214-1974. At 08:06 the box leaves the north courtyard. At 08:14 its contents are deposited in compartment OC-C-18 of the common ossuary. The compartment already held remains from another twenty-seven licences and is closed after the deposit.

At 08:23 the vacated niche is handed over to the cleaning and refitting unit. No material incidents are recorded.

Signed: Bernabé Coz. Professional code: JSF-09.

DECISION ON REASSIGNMENT. 7 October 2024.

Niche 214 is declared available and is assigned to the first compatible application on the waiting list, filed on 9 January 2024. The new licence will begin once the technical refitting is complete.

The application out of time is to be filed together with its decision, the record of exhumation and the reference of the common ossuary.

Electronic signature of Bernabé Coz, head of funeral services.

CLOSING RECORD. 7 October 2024, 12:04.

Purificación Adame stamps the word EXECUTED across Amalia Roldán Sanz's application and writes her employee number underneath: 0417.
